  • Preamble

By validating his/her order, the Customer declares that he/she accepts without reservation the terms of said order as well as the entirety of the present general conditions of sale.

  • Article 1 – Purpose

The purpose of this contract is to sell works of art online from the www.galeriedeza.com website.

  • Article 2 – Rates and payment methods

The current prices can be consulted at any time on the www.galeriedeza.com website. They do not include packaging and delivery costs.

galeriedeza.com reserves the right to change prices without notice.

To become a customer, you need to open an account by filling in the online form. Several payment methods are available:

By credit card

using a secure procedure (SSL) and guaranteed via PAYPAL.

We certify that credit card details are encrypted using SSL (Secure Soket Layer) protocol, and are never transmitted unencrypted over the network. Payment is made directly to the bank.

Payment by cheque

Select this payment method on the payment summary page. Payment by check is possible for orders from France only.

With payment by cheque, your order is reserved for 72 hours.

Payment in instalments possible (please contact us).

  • Article 3 – DELIVERY

The products will be delivered to the address indicated on the order form (only in metropolitan France).
All works are carefully packaged and sent as soon as possible by registered mail with acknowledgement of receipt.
Galerie DEZA charges a flat rate for packaging and postage for metropolitan France.

  • Article 4 – Customary checks on delivery

We invite you to check (or have the receiving agent check) the apparent condition of the works on delivery with the delivery person. Whatever the carrier and in the presence of an apparent anomaly (damage, missing product compared to the delivery note, damaged or broken package, etc.), you must obligatorily :

– Unpack the parcel in the presence of the delivery person, and
– Make detailed handwritten reservations and have the letter carrier sign next to them. Reservations made by the consignee on delivery constitute proof of the existence and extent of the damage. Make sure they are precise and complete (the simple mention “subject to unpacking” is considered too general and imprecise), and
– Inform GALERIE DEZA by registered mail within three (3) working days of delivery of your package.

In the event of any problems upon receipt, it is essential that you keep the items in the condition in which they were delivered, including packaging.

If the works need to be returned, you must submit a request for return by post addressed to “GALERIE DEZA – 11 rue Alexandre Roche – 42300 Roanne”.

This request must be accompanied, where applicable, by a copy of the letter sent to the carrier or the “spoliation report” or “anomaly report” obtained from the carrier. In the absence of a transport anomaly,

In any case, these precautions do not prevent you from benefiting from legal guarantees and exercising your right of withdrawal.

  • Article 5 – Right of withdrawal

In accordance with current legislation, we grant you a cooling-off period of 14 calendar days to return, at your own expense, any works of art that do not suit you. These deadlines run from the day after receipt of the product. Once these deadlines have expired, you no longer have this right of withdrawal.

  • Article 6 – Access to the service

Access to galeriedeza.com is available 24 hours a day, 7 days a week, except in cases of force majeure or maintenance work.

  • Article 7 – Intellectual property of content and image rights

The Customer does not have any intellectual property rights on the Works presented and cannot therefore redistribute or copy the images of the Works presented on galeriedeza.com .

All the Works, whatever their presentation, are protected by the legislation applicable to intellectual property throughout the world. In this respect, any use other than those strictly authorized by law or the present terms and conditions constitutes an infringement and is punishable under the provisions of the French Intellectual Property Code.

  • Article 8 – Data Protection Act

In accordance with the French law “Informatique et libertés” n°78-17 of January 6, 1978, you have the right to access and rectify data concerning you. You can exercise this right by sending a letter to the following address: “GALERIE DEZA, 11 rue Alexandre Roche – 42300 – Roanne”.

Depending on the choices you make when creating or consulting your account, you may receive offers from our company. If you no longer wish to do so, you can ask us to do so at any time via your customer area or by writing to us at the above address.

We inform you that this automated processing of information, in particular the management of users’ e-mail addresses, has been declared to the CNIL.

  • Article 12 – Applicable law and jurisdiction

This contract is governed by French law. In the event of a dispute concerning the application or interpretation of this contract, the parties agree to seek an amicable solution. Failing this, the courts shall have sole jurisdiction.
